Video of prosecutor’s threatening behavior shown in Osaka court
Video showing a prosecutor attempting to intimidate an interviewee has been shown at the Osaka District Court as part of a damages lawsuit filed by a man acquitted in an embezzlement case.
横領事件で無罪判決を受けた男性が起こした損害賠償請求訴訟の一環として、検察官が取材対象者を威嚇しようとする様子を映したビデオが大阪地方裁判所で公開された。
The 25-minute footage was shown on Friday in the suit filed by Yamagishi Shinobu, who used to run a real estate company.
He was charged with embezzlement in connection with a land deal five years ago, but later acquitted.
Yamagishi is demanding that the state pay damages. He says an investigator from the Osaka District Public Prosecutors Office, Tabuchi Daisuke, conducted an illegal inquiry by threatening his former employee.
The prosecutors submitted the footage after the Supreme Court upheld Yamagishi’s request that it be shown in the trial.
In the video, Tabuchi asks the interviewee whether Yamagishi’s employees shared information on the investigation to ensure that their accounts would not contradict each other.
When the interviewee answers no, Tabuchi bangs on a desk and shouts: “You’re lying! Don’t try to make fools of us!”
Tabuchi has already admitted that his behavior was inappropriate, and said he wanted the interviewee to sincerely answer his questions.
The trial closed on Friday. The court will announce its decision on whether the state is liable for compensation on March 21.
Tabuchi will face a criminal trial for his conduct. According to the Supreme Court, the case will be the first in Japan in which a prosecutor stands trial on criminal charges regarding an inquiry by a prosecutorial special investigation department.

この25分間の映像は、かつて不動産会社を経営していた山岸忍氏が起こした訴訟で金曜日に公開された。
彼は5年前の土地取引に関する横領で起訴されたが、後に無罪となった。
山岸氏は国に対して損害賠償を要求している。彼によれば、大阪地検特捜部の田淵大輔という捜査官が、元従業員を脅して違法な捜査を行ったという。
検察は、最高裁が山岸氏の裁判での上映要求を支持したため、この映像を提出した。
映像の中で田淵被告は、山岸被告の元従業員に対し、互いの証言が矛盾しないように捜査情報を共有したかどうかを尋ねている。
インタビュイーが「ノー」と答えると、田淵氏は机を叩いて叫んだ： 「お前は嘘をついている！私たちをバカにするな！”と。
田淵被告はすでに自分の行動が不適切であったことを認めており、取材対象者に自分の質問に真摯に答えてほしかったと語っている。
裁判は金曜日に閉廷した。国が賠償責任を負うかどうかの判決は21日に発表される。
田淵被告は刑事裁判を受けることになる。最高裁によると、検察特捜部の取り調べをめぐって検察官が刑事責任を問われる裁判は全国初という。
